Civil status deed correction in Brussels

An error in a civil status deed (birth, marriage, death, recognition) can have important consequences : misspelled name, wrong date, incorrect place, parentage to correct. Since the law of 18 June 2018 (in force on 31 March 2019), the correction procedure is split between the civil status officer (simple material errors) and the Family Court (substantive errors). Sarah Satti guides you in identifying the right path and representing your interests.

What types of errors can be corrected ?

Errors eligible for correction are varied :

- Material error : typing mistake, misspelled first name, reversed date

- Transliteration error : incorrect transcription of foreign names (Arabic, Cyrillic alphabet…)

- Incorrect application of foreign law : foreign deed transcribed with legal qualification error

- Error regarding parentage : wrong father/mother mentioned

- Missing deed : need to establish a substitute deed (article 26 Civil Code)

- Deed annulment : deed established on the basis of fraud or fundamental error

Administrative path : the civil status officer

For a simple material error (typing mistake, missing accent), the civil status officer of the municipality can correct directly by marginal note, after favourable opinion of the Public Prosecutor.

This procedure is free and fast (a few weeks). It does not require a lawyer, but legal assistance remains recommended to frame the request and speed up processing.

Judicial path : the Family Court

For any substantive error (parentage, incorrect application of foreign law, suspected fraud), only the Family Court is competent.

The procedure runs by petition filed with the family court registry (4th floor of the Brussels Tribunal), with possibility of electronic filing via e-Deposit. The Public Prosecutor is heard ex officio. Once the judgment has force of res judicata, the clerk transmits the data via the BAEC (Belgian Civil Status Records Database) for automatic updating.

Special case : foreign deeds and BAEC

The modernisation of civil status (BAEC since 2019) facilitates the correction of foreign deeds transcribed in Belgium.

If a foreign deed contains an error (for example, transliteration of an Arabic name), correction can be requested from the civil status officer of the municipality of transcription or from the Family Court depending on the severity of the error.

Frequently asked questions

Since the reform of civil status that came into force on 31 March 2019, a material error is rectified by the civil registrar. Other rectifications fall to the family court, and the person concerned may apply to it without a lawyer; a lawyer's assistance remains useful to qualify the error (material or substantive), to draft the petition and to follow its processing by the registry or Public Prosecutor. The provision allowing this is article 35, § 1 of the former Civil Code: a person wishing to have an act rectified or annulled, or to have a missing act supplied in accordance with article 26, may file a petition to that effect with the family court. No mandatory involvement of a lawyer appears there. The same article nonetheless shows that the request does not always come from the person concerned, which changes how a case is approached. The civil registrar of the place where the act was drawn up may bring the matter before the court, and that petition must then be signed by the registrar or by a lawyer. The public prosecutor may also do so, upon finding an error.
